This Return Policy governs all purchase transactions made through the NOEMÍ website located at noemicollective.com, operated by NOEMÍ, a sole proprietorship organized under the laws of the State of California (hereinafter referred to as "NOEMÍ," "we," "us," or "our"). By completing a purchase through our website, you acknowledge that you have read, understood, and agreed to the terms set forth in this policy.

This Return Policy is incorporated by reference into our Terms of Service and constitutes a binding agreement between you (the "Customer" or "Purchaser") and NOEMÍ with respect to the return, exchange, and refund of purchased goods. In the event of any conflict between this Return Policy and our Terms of Service, the terms of this Return Policy shall govern with respect to matters of return, exchange, and refund.

1. Eligibility for Returns

1.1 Standard Return Window

Subject to the exclusions set forth in Section 3 of this policy, NOEMÍ accepts returns of eligible merchandise within fourteen (14) calendar days of the confirmed delivery date as recorded by the applicable shipping carrier. The delivery date shall be determined by reference to the carrier's tracking records and shall constitute the commencement date of the return window.

To be eligible for a return, the merchandise must satisfy all of the following conditions at the time it is received by NOEMÍ:

  • The item must be unused, unworn, and unaltered in any manner

  • The item must be free from signs of use, soiling, odor, or any condition inconsistent with its original state at the time of shipment

  • The item must be returned in its original packaging where applicable

  • The item must not fall within any category of non-returnable merchandise as defined in Section 3 of this policy

NOEMÍ reserves the sole and absolute discretion to assess the condition of returned merchandise upon receipt and to determine whether the item satisfies the eligibility criteria set forth herein. Items that do not meet these criteria will not be accepted for return and will be returned to the Customer at the Customer's expense, or held pending the Customer's instruction.

1.2 Initiation of Return

To initiate a return, the Customer must contact NOEMÍ through the Contact page on our website at noemicollective.com within the fourteen (14) day return window described in Section 1.1. The Customer must provide the following information at the time of contact:

  • Full name as provided at the time of purchase

  • Order number as reflected in the order confirmation email

  • A description of the reason for the return

  • Photographic documentation of the item's current condition where applicable

Returns initiated without prior authorization from NOEMÍ will not be accepted. NOEMÍ will not be responsible for any merchandise returned without prior written authorization, and such merchandise may be refused or returned to the sender at the Customer's expense.

2. Exchanges

2.1 Exchange Eligibility

NOEMÍ accepts exchanges for eligible merchandise within the same fourteen (14) calendar day window and subject to the same conditions of eligibility described in Section 1 of this policy. Exchanges are subject to product availability at the time the exchange request is processed. In the event that the requested exchange item is unavailable, NOEMÍ will offer the Customer a refund in accordance with Section 4 of this policy.

2.2 Initiation of Exchange

To initiate an exchange, the Customer must contact NOEMÍ through the Contact page on our website within the applicable return window, providing the same information required for a return as set forth in Section 1.2, along with a description of the desired exchange item. Exchange requests are subject to approval by NOEMÍ at our sole discretion.

3. Non-Returnable and Final Sale Merchandise

3.1 Personalized and Custom Orders

All personalized merchandise — defined as any item that has been customized, altered, or modified at the Customer's request, including but not limited to items bearing gold foil stamping, monogramming, or any other form of personalization applied at or after the time of order — is designated as final sale and is expressly excluded from NOEMÍ's return and exchange policy.

Personalized merchandise is manufactured specifically to fulfill the Customer's individual order and cannot be restocked, resold, or repurposed upon return. Accordingly, all sales of personalized merchandise are final and non-refundable, except as provided in Section 5 of this policy with respect to items that arrive damaged or defective.

The Customer is solely responsible for reviewing and confirming all personalization details — including spelling, formatting, and placement — prior to completing the order. NOEMÍ shall not be liable for errors in personalization resulting from inaccurate or incomplete information provided by the Customer at the time of purchase.

3.2 Items Not in Original Condition

Any item that has been used, worn, altered, damaged, or otherwise rendered inconsistent with its original condition after delivery is not eligible for return or exchange under any circumstances. NOEMÍ reserves the right to refuse any return that does not meet the eligibility conditions set forth in Section 1.1 and to return such merchandise to the Customer at the Customer's expense.

3.3 Items Returned Outside the Return Window

NOEMÍ will not accept returns or exchanges for merchandise presented for return after the expiration of the fourteen (14) day return window described in Section 1.1, except where required by applicable law or as expressly authorized by NOEMÍ in writing at our sole discretion.

4. Refunds

4.1 Refund Processing

Upon receipt and inspection of eligible returned merchandise, NOEMÍ will process a refund to the original payment method used at the time of purchase. Refunds will be issued within a commercially reasonable timeframe following NOEMÍ's acceptance of the returned item, subject to the processing timelines of the applicable payment processor. NOEMÍ is not responsible for delays in refund processing attributable to third-party payment processors or financial institutions.

4.2 Partial Refunds

In circumstances where a returned item is received in a condition that does not fully satisfy the eligibility requirements of Section 1.1 but which NOEMÍ, at its sole discretion, elects to accept, NOEMÍ reserves the right to issue a partial refund reflecting a reasonable assessment of the item's diminished condition.

4.3 Original Shipping Costs

Original shipping costs are non-refundable except in cases where the return is the direct result of an error on the part of NOEMÍ, including but not limited to the shipment of an incorrect item or an item that is defective at the time of dispatch. In all other eligible return scenarios, the refund will reflect the purchase price of the returned merchandise only, exclusive of any shipping charges paid at the time of order.

4.4 Return Shipping Costs

Unless the return is the result of NOEMÍ's error or a confirmed product defect, the Customer is responsible for all costs associated with return shipping. NOEMÍ recommends that Customers use a trackable shipping method and retain proof of shipment. NOEMÍ is not responsible for returned merchandise that is lost, damaged, or delayed in transit.

5. Damaged or Defective Items

5.1 Reporting Requirements

In the event that a Customer receives merchandise that arrives in a damaged or defective condition, the Customer must notify NOEMÍ through the Contact page on our website within seven (7) calendar days of the confirmed delivery date. The notification must include:

  • The Customer's full name and order number

  • A written description of the damage or defect

  • Photographic documentation clearly depicting the damage or defect

Claims submitted outside of the seven (7) day reporting window may not be eligible for resolution at NOEMÍ's discretion. NOEMÍ strongly encourages Customers to inspect all merchandise promptly upon delivery.

5.2 Resolution

Upon receipt and review of a valid damage or defect claim submitted in accordance with Section 5.1, NOEMÍ will, at its discretion, offer one of the following remedies: a replacement of the affected item subject to availability, or a full refund of the purchase price including original shipping costs. The determination of the appropriate remedy shall be made by NOEMÍ in good faith based on the nature and extent of the reported damage or defect.

This provision applies equally to personalized merchandise that arrives in a damaged or defective condition, notwithstanding the final sale designation set forth in Section 3.1.

6. Installment Payment Orders

Orders completed through installment payment services, including Klarna and Afterpay, are subject to the same return and refund eligibility criteria set forth in this policy. In the event that a refund is approved for an order placed through an installment payment provider, the refund will be processed in accordance with the terms and procedures of the applicable installment payment provider. NOEMÍ is not responsible for the timing or administration of refunds as managed by third-party installment payment services. The Customer should consult the applicable provider's terms directly for information regarding refund processing on installment transactions.

7. Consumer Rights Under California Law

Nothing in this Return Policy is intended to limit or supersede any rights afforded to consumers under applicable California law, including but not limited to the California Consumer Legal Remedies Act (Civil Code § 1750 et seq.) and the Song-Beverly Consumer Warranty Act. To the extent that any provision of this policy conflicts with applicable law, the applicable law shall govern.

California consumers have certain statutory rights with respect to defective goods that exist independently of and in addition to the terms of this Return Policy. NOEMÍ acknowledges and respects those rights.

8. Modifications to This Policy

NOEMÍ reserves the right to modify, amend, or update this Return Policy at any time without prior notice. Any modifications will be effective upon posting to our website with an updated effective date. The Return Policy in effect at the time of your purchase shall govern your transaction. We encourage Customers to review this policy prior to completing any purchase.
